The Baker County Planning Commission will hold a public hearing for Conditional Use Permit application CU-16-001 at 6:00 p.m. on February 25th, 2016, in the Commissioner’s Chambers located in the Baker County Courthouse, 1995 Third Street, Baker City, Oregon. Philip Wirth has requested approval for a mining bunkhouse at 23476 Clarks Creek Road in the Mineral Extraction (ME) Zone, identified as Tax Lot 3100 in Section 27 of Township 12 South, Range 41 East, W.M., Baker County, OR (Ref.18128). 

CU-16-001 will be reviewed using criteria in Baker County Zoning Ordinance #2014-01 Sections 205.06, 210.05 (B), 210.06, 440.05 (C), 340.05.008, 360.04 and the Comprehensive Plan. Generally, unless otherwise noted, if a request is found to be consistent with the Zoning Ordinance it is considered to be consistent with the Comprehensive Plan. This request will also be reviewed under Oregon Administrative Rule 660-023-0115. 

A copy of the application, all documents and evidence submitted by or on behalf of the applicant, and the applicable criteria are available for inspection at no cost by email, or can be provided at reasonable. The staff report the Planning Commission will use in its decision making process for this request will be available for inspection at the Baker City-County Planning Department by February 25th, 2016. All interested persons are invited to attend this meeting. Persons wishing to comment on the proposed application may do so by presenting oral testimony at the hearing, or by submitting written testimony. Testimony should avoid repetition of issues, be based on the application, and address the criteria listed above. Only comments on the relevant approval criteria are considered applicable evidence. Telephone conversations cannot be accepted as testimony. All written testimony must be submitted to the Planning Department by no later than 5:00 p.m. on the hearing date, or in person during the hearing. Failure to raise an issue in a hearing, or failure to provide statements or evidence sufficient to afford the decision maker an opportunity to respond to the issue, precludes appeal to the Land Use Board of Appeals (LUBA) based on that issue.
