PUBLIC NOTICE – County Cases PA-15-002 and PA-15-003

 

The purpose of this notice is to give nearby property owners and other interested persons an opportunity to submit testimony regarding applications before the decision is made.

 

PA-15-002: Tom and Fawn Kerns are the owners of an ±81 acre property located in Baker County on Tax Lot 4001 of Township 8 South, Range 38 East (Assessor’s Map 8s38e).  The property is currently zoned Exclusive Farm Use (EFU) and applicants propose to rezone the property to Timber Grazing (TG).  For more information, contact Planner Kelly Howsley-Glover at 541-523-8219.

 

PA-15-003: Parvaim Mining, LLC is the owner of property located in Baker County on Tax Lot 100 of Assessor’s Map 09s37e29b (Ref #13980), which is currently zoned Rural Residential (RR-5). The subject property is part of the Sumpter Deep Gravel Mining Claim patent. Page V-106 of the Baker County Comprehensive Land Use Plan states, “patented mining claims in Baker County...are within the Mineral Extraction Zone." Zoning maps created by Baker County in 1983 classified the property as RR-5 with no explanation as to why the patent was not considered in this zoning, as the language in the Comprehensive Land Use Plan clearly intends for patented mining claims to be zoned Mineral Extraction. In order to correct what appears to be a mapping error, a proposal to re-zone the subject property has been made. This re-zoning would change the zoning of tax lot 100 from Rural Residential (RR-5) to Mineral Extraction (ME). For more information, contact Eva Ceder at 541-523-8219.

 

The Baker County Zoning Ordinance (BCZO) requires a Plan Amendment to be processed as a Type IV procedure, which is a quasi-judicial process where the final decision is made by the Baker County Board of Commissioners after public notice and public hearing and a recommendation from the Planning Commission. In determining whether to grant the request, the Board of Commissioners will use the applicable criteria listed in BCZO Sections 260, 360, 410, 420 and 440.

 

A copy of the application, all documents and evidence submitted by or on behalf of the applicant, and the applicable criteria are available for inspection at no cost and will be provided at reasonable cost. A digital copy of the documents can be emailed to you at no cost, or a hard copy can be mailed to you by post mail, upon request, for a reasonable cost. 

 

Persons wishing to comment on the proposed application may do so by submitting written testimony to the Baker County Planning Department.   The first hearing on this matter will be before the Baker County Planning Commission, who will develop a recommendation on this matter to the Board of Commissioners. The hearing will be on Thursday, June 25, 2015 beginning at 6:00pm. All written testimony to be provided to the Planning Commission must be submitted to the Planning Department by no later than 5:00 p.m. on, Thursday, June 25, 2015. Testimony may also be given in person by attending either hearing.

 

Hearings before the Board of Commissioners are scheduled for July 1, 2015 for PA-15-003 (Parvaim) and July 1 and 15, 2015 for PA-15-002 (Kerns).  After a determination is made by the Board of Commissioners, there will be a 21-day appeal period to the Land Use Board of Appeals. If no appeals are filed the Plan Amendment decisions are considered final.
